These Terms of Service (“Terms”) govern your use of fresh-pen.com and any purchase made from FreshPen (“FreshPen,” “we,” “us,” or “our”). By placing an order or creating an account with us, you agree to these Terms. Please read them carefully before shopping with us.
About Our Products
FreshPen products are topical cosmetic formulations intended for external application to the skin only. They are not medicines, medical devices, or dietary supplements, and they are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Nothing on this site constitutes medical advice. If you have a skin condition, are pregnant or breastfeeding, or are otherwise concerned about a product’s suitability for you, please consult a qualified healthcare professional before use.
Every batch we sell is independently tested by third-party laboratories, and the resulting Certificate of Analysis (COA) is available on our COA pages or on request at support@fresh-pen.com. Always follow the usage directions and storage instructions printed on the product packaging.
Eligibility
You must be at least 18 years old to place an order with FreshPen. By ordering, you confirm that you meet this requirement and that the billing and shipping details you provide are accurate and complete. We currently ship within Indonesia only.
Orders and Payment
We accept the following payment methods at checkout:
- Bank transfer, QRIS, or cash on delivery (COD), coordinated via WhatsApp after you place your order
- Credit/debit cards, where available
- USDT (TRC20 network) cryptocurrency, with a unique payment amount generated for your order
Orders paid via bank transfer, QRIS, COD, or USDT are held with an “on-hold” status until payment is received and confirmed by our team (or, for USDT, verified on-chain). We reserve the right to cancel an order that remains unpaid for an extended period. All prices are listed in Indonesian Rupiah (IDR) and include any applicable membership discount automatically calculated at checkout.
Membership Tiers
Registered customers are automatically placed into a membership tier (Silver, Gold, or Platinum) based on lifetime spend, with Gold and Platinum members receiving an automatic discount on future orders. Tier thresholds, discount rates, and benefits are shown in your Account dashboard and may be adjusted by FreshPen from time to time; any change will apply prospectively and will not remove a discount already applied to a completed order.
Referral Program
Customers may share a personal referral link from their Account dashboard. Referral commissions and rewards, where offered, are credited at FreshPen’s discretion once the referred order is confirmed and paid, and may be adjusted or discontinued at any time.
Shipping and Delivery
Our products are shipped using cold-chain packaging designed to keep them within their recommended temperature range in transit. Please inspect your parcel as soon as it arrives and contact us immediately if the packaging or insulation appears compromised. Estimated delivery times are provided at checkout and during order tracking, but are not guaranteed, as they depend on our shipping partners and factors outside our control.
Returns and Refunds
Returns, exchanges, and refunds are handled under our separate Refund and Returns Policy, which forms part of these Terms.
Intellectual Property
All content on fresh-pen.com — including the FreshPen name and logo, product photography, page layouts, and written copy — is owned by FreshPen or its licensors and may not be copied, reproduced, or used commercially without our prior written permission.
Limitation of Liability
To the maximum extent permitted by law, FreshPen is not liable for indirect, incidental, or consequential damages arising from your use of our site or products, or from delays or issues caused by shipping carriers, payment networks, or blockchain infrastructure outside our control. Nothing in these Terms limits any right you have under applicable Indonesian consumer protection law that cannot lawfully be excluded.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our products, policies, or applicable law. The updated version will be posted on this page with a revised effective date, and continued use of our site after changes are posted constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles.
